Employer’s Liability Claims

A claimant living in Donegal instigated an Employer’s Liability claim against his last employer for an injury to his back sustained in the course of his employment on the employer’s premises. He claimed that he was severely incapacitated as a result, was unable to return to work and was now forced to return to college to further his education to obtain alternative employment.

The employer’s liability insurer commissioned our services to carry out surveillance to ascertain the claimant’s current level of activity and employment status to establish if these were consistent with his claim.

Surveillance established that the individual was in fact working as a Builder and video footage was obtained of him engaged on the construction of a private dwelling house in the south of the county. He was filmed lifting heavy building blocks and timbers, climbing up and down ladders with no apparent difficulty and digging sand with a shovel.

This resulted in massive potential savings to the insurance company who were subsequently able to deal with the claim in a favourable out of court settlement.
