A client contacted us after they received information that one of their employees, who was off sick for the week, was believed to be working in a pub in Cork City. Ryan Ireland, who has offices in Cork, was able to cover this enquiry at short notice as the subject was due back in work within the week. Surveillance at the pub on a Friday evening established that the claimant was not a barman but in fact a member of the ‘door staff’ for the adjacent nightclub. Returning the following evening, video evidence was obtained of the individual as he stood outside the main entrance to the venue vetting patrons and carrying out the duties expected of ‘Door Security’. He presented himself in a normal manner and displayed no evidence of the alleged illness that kept him off work.
When confronted with the evidence the following week, he admitted to working whilst off sick and indeed admitted to further breaches of work practices whilst off sick on earlier occasions.
